In September 2017, Jim Gatto, Adidas' director of global sports marketing, was arrested on charges of fraud, bribery and corruption following an FBI investigation dating back to 2015. The money was given to an unnamed N.C. State basketball coach by an adidas consultant, according to the indictment.
Because of this, Skechers filed a lawsuit stating the company was put at a disadvantage in getting athletes to wear their shoes because Adidas had secretly been making deals with athletes at big schools such as NC State and Kansas.
In contrast, Nguyen said Adidas failed to show that consumers would associate it with Skechers' Cross Court, causing the dilution of Adidas' reputation as a "premium" brand.

A US appeals court on Thursday said Adidas AG can protect its famous Stan Smith tennis shoe against an alleged Skechers USA Inc knockoff, but that Skechers could sell another shoe mimicking Adidas' familiar "three-stripe" design. Today, the Ninth Circuit Court of Appeals upheld an earlier injunction prohibiting the sale of the Skechers Onix shoe.
In its case filed yesterday against Adidas, Skechers has requested a jury trial to address its claims about unfair competition.
Skechers is asking for "an award of the profits" and damages of an undetermined amount.
